Acceptance of Terms

By accessing or using any portion of the EXTER FUNKY website, creating an account, purchasing a course, or otherwise engaging with our platform, you confirm that you have read, understood, and agree to be legally bound by these Terms of Service, along with our Privacy Policy and Refund Policy, all of which are incorporated herein by reference.

If you do not agree to these terms in their entirety, you are prohibited from using our services. These terms apply to all users of the site, including students, visitors, browsers, vendors, and any other contributors of content.

EXTER FUNKY reserves the right to update, amend, or replace any part of these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the platform after any changes constitutes your acceptance of the new terms. It is your responsibility to review these terms periodically.

Eligibility and Account Registration

To access certain areas of our platform, you may be required to register for an account. By registering, you represent and warrant that:

• You are at least 18 years of age or have parental/guardian consent.
• All registration information you provide is truthful, accurate, and current.
• You will maintain the accuracy of your information and update it as necessary.
• You are not accessing the platform from a jurisdiction where such access is prohibited by law.
• Your use of the platform will not violate any applicable laws or regulations.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@exterfunky.com if you suspect unauthorized access to your account. EXTER FUNKY will not be liable for any loss or damage arising from your failure to protect your login credentials.

Course Access and Intellectual Property

Upon purchase of a course, EXTER FUNKY grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and view the course content for personal, non-commercial educational use only. This license does not include:

• The right to reproduce, distribute, or publicly display any course content.
• The right to create derivative works based on the course content.
• The right to share your login credentials with others to grant access to purchased content.
• The right to record, capture, or extract any portion of the video lessons, PDF guides, or pattern sheets.
• Commercial use of patterns, techniques, or designs derived exclusively from our proprietary materials.

All content on the EXTER FUNKY platform — including but not limited to video lessons, written guides, pattern designs, illustrations, audio, trademarks, and branding — is the exclusive intellectual property of Exter Funky LLC and is protected by United States and international copyright, trademark, and trade secret laws.

Any unauthorized use, reproduction, or distribution of our content may result in immediate account termination and may subject you to civil and criminal penalties.

Payments, Pricing, and Billing

All course prices are listed in United States Dollars (USD) and are subject to change without prior notice. Applicable sales taxes may be added at checkout depending on your location and applicable tax laws.

Payment is processed securely through third-party payment processors. By submitting a payment, you authorize EXTER FUNKY to charge your chosen payment method for the total amount displayed at checkout. You represent that you are authorized to use the payment method provided.

In the case of monthly subscription add-ons (such as our Practice Homework Add-On), you authorize recurring billing on the date of your original purchase each month until you cancel. Cancellation must be made at least 48 hours before the next billing cycle to avoid being charged for the upcoming period.

EXTER FUNKY is not responsible for any charges, fees, or currency conversion costs applied by your financial institution or payment provider.

User Conduct and Community Guidelines

By using our platform, you agree to engage respectfully and constructively. You must not:

• Post or transmit any content that is defamatory, abusive, harassing, threatening, or discriminatory.
• Impersonate any person or entity, or falsely misrepresent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or any other code designed to disrupt, damage, or limit the functioning of the platform.
• Attempt to gain unauthorized access to any part of the platform, its servers, or its databases.
• Use automated scripts, bots, scrapers, or data mining tools on the platform.
• Engage in any activity that interferes with or disrupts other users' enjoyment of the platform.
• Share, reproduce, or sell any course content to third parties.

EXTER FUNKY reserves the right to terminate accounts, remove content, and restrict access at our sole discretion for any violation of these guidelines, without refund or notice.

Disclaimers and Limitation of Liability

EXTER FUNKY provides all courses and content "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Results from taking our courses will vary based on individual effort, skill level, and practice. We make no guarantee of specific outcomes, career results, sales figures, or income from craft activities.

To the maximum extent permitted by applicable law, EXTER FUNKY, its directors, employees, agents, instructors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of (or inability to use) the platform or its content.

Our total liability in any circumstance is limited to the amount you paid for the specific course or service giving rise to the claim, in the twelve months preceding the date of the claim.

Third-Party Links and Services

Our platform may contain links to third-party websites, tools, or services that are not owned or operated by EXTER FUNKY. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. We strongly advise you to review the privacy policy of every site you visit.

We may recommend specific tools, materials, or suppliers as part of our course content. These recommendations are made in good faith for educational purposes and do not constitute endorsements. EXTER FUNKY is not liable for any purchases, interactions, or disputes arising from third-party platforms.

Termination

EXTER FUNKY reserves the right to suspend or permanently terminate your account at any time, at our sole discretion, with or without cause and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms of Service, fraudulent activity, abuse of the platform, or actions that harm the EXTER FUNKY community.

Upon termination, your license to access course content will immediately cease. If termination is due to a violation of these terms, no refund will be issued. If we terminate your account for reasons other than a policy violation, we may, at our discretion, offer a pro-rated refund.

Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these terms or your use of the EXTER FUNKY platform shall first be submitted to informal mediation. If mediation fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with arbitration conducted in Albuquerque, New Mexico.

You waive any right to a jury trial or to participate in a class action lawsuit against EXTER FUNKY. Claims must be brought within one (1) year after they arise, or they are permanently barred.

Entire Agreement and Severability

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and EXTER FUNKY concerning your use of our platform and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The failure of EXTER FUNKY to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
